Petitioner was allegedly found in possession of 10 gms. of heroin. On account of report of chemical examiner having not been received, he was granted interim temporary bail on 26.3.2015. He was not able to furnish bail bonds on 26.3.2015. The matter appears to have been adjourned and the bail bonds of the petitioner appear to have been accepted on a later date. The petitioner during the period of interim temporary bail absented on 7.1.2016, as a result of which, bail bonds were cancelled and forfeited to the State. Petitioner has approached this Court for concession of pre-arrest bail.

CRM-M-10740-2016 (O&M) I have considered the facts and circumstances of this case. The petitioner in the garb of instant petition cannot be granted the concession of pre-arrest bail in the main case. At this stage, the only relief which can be granted to the petitioner is that he would remain on interim bail till the presentation of the report of Forensic Science Laboratory as no effective hearing or proceedings are to take place before the said Court till the challan is presented along with the report of Forensic Science Laboratory.

This petition is disposed of with a direction that the petitioner will remain on interim temporary bail till presentation of challan along with report of Forensic Science Laboratory subject to his appearing before the Special Judge, Tarn Taran, within a period of one week after receipt of certified copy of this order. In case of petitioner putting in appearance within the above said period, he will be restored to his original position i.e., he will be granted interim bail on his furnishing fresh bail bonds/surety bonds till presentation of report of Forensic Science Laboratory.

It is made clear that in case the petitioner does not comply with the above said direction, this petition will be deemed to have been dismissed.
