RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner Surjit Singh in case arising from FIR No.103 dated 10.08.2017 registered under Sections 15 and 29 of the Narcotic Drugs and Psychotropic Substances Act at Police Station Pasiana, District Patiala.
Learned counsel for the petitioner inter alia contends that the petitioner is in custody since 01.03.2018. Co-accused of the petitioner, namely, Manjit Kaur has already been granted regular bail by a Co-ordinate Bench of this Court vide order dated 21.05.2018. On the other hand, learned State counsel vehemently opposed the bail application.
Considering overall facts and circumstances and treating the case of the petitioner on the same parity as that of his co-accused, but without expression any opinion on the merits of the case, the petition is allowed.
