**** HARKESH MANUJA, J. (ORAL) By way of present writ petition filed under Article 226 of Constitution of India, prayer has been made for issuance of an appropriate writ, order or direction especially in the nature of Habeas Corpus for releasing the detenue namely Jyoti Singh who happens to be the wife of petitioner from the alleged illegal custody of respondents No.6 to 12.

In response, learned State counsel on instructions from ASI Gurdeep Singh, City-1 Moga has produced an affidavit dated 26.02.2024, executed by the detenue-Jyoti Singh, wife of the petitioner, wherein, she states that she is living in house No.434/1, Samdaria Colony, Kalchuri Vihar, Police Station South Civil Line, Jabbalpur (Madhya Pradesh) along with her mother and other relatives and she is being safe and sound.

A photocopy of the said affidavit has also been handed over to the learned counsel for the petitioner who on perusal thereof, wishes to withdraw the present petition with liberty to avail his remedies in accordance with law.

In view of the above, the present petition is disposed of being not pressed with aforesaid liberty.
