Mr. Ajay Sharma, DAG Haryana along with Mr. Satish Kumar, Suptd., O/o Director Health Service (Malaria), Sector 6, Panchkula.

* * * * This petition was filed during the year, 2001 seeking a writ of mandamus directing the respondent-authorities to pay interest @ 18% per annum w.e.f. July 31, 1997 till the date of payment of retiral benefits. There is no dispute that all the arrears of retiral benefits were paid long back. During the pendency of the writ petition, the petitioner died. Even his widow has died. The death certificates of the petitioner as also of his widow have been placed on record by the respondent-department. Legal representatives of the petitioner have not been brought on record despite providing opportunities on 3-4 occasions. In the circumstances, this writ petition is ordered to be consigned to record with liberty to the LRs of the petitioner to get it revived after moving an appropriate application.
