'( 1. Through the instant petition, as instituted under Section 438 of the Cr.P.C., the petitioner has sought the concession of pre-arrest bail, in case FIR No.29 dated 25.01.2024, under Section 307 of the IPC, registered at P.S. Rama Mandi, District Police Commissionerate Jalandhar.
2. The learned counsel for the petitioner submits that a matrimonial dispute has deliberately been camouflaged as a criminal offence. A bare perusal at the allegations, as levelled in the instant FIR, reveals that no offence under Section 307 of the IPC is made out. Nonetheless, even if the allegations are taken to be a gospel truth, even then the offence if any, which could be attracted, is of attempt to cause injuries.
3. Notice of motion for 03.04.2024.
4. Mr. Pardeep Bajaj, D.A.G., Punjab, accepts notice on behalf of respondent-State of Punjab.
5. In the meantime, the petitioner is directed to join the AMANDEEP GOSAIN 2024.04.26 12:45 I attest to the accuracy and integrity of this order/judgment
investigation and to appear before the investigating agency, as and when called upon to do so. In the event of his arrest, he shall be admitted to interim bail on his furnishing bail bonds to the satisfaction of the Arresting/Investigating Officer.
