*** NIDHI GUPTA, J (Oral) This petition has been filed under Article 227 of the Constitution of India for setting aside the order dated 02.11.2021 (Annexure P2), whereby defence of petitioner/defendant was struck off as he had failed to file written statement.

Mr. Umesh Aggarwal, Advocate, puts in appearance for respondent No.1 and filed vakalatnama, which is taken on record. It is fairly stated by learned counsel for respondent No.1 that one opportunity, in the interest of justice, be given to the petitioner to file his written statement.

Accordingly, one last opportunity is granted to the petitioner to file his written statement before the learned Court below, however, subject to payment of Rs.7000/- as costs.
