Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.47 dated 14.02.2016 under Sections 420 and 120-B IPC, registered at Police Station Civil Lines, Amritsar.

Notice of motion was issued and learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that the allegations against the present petitioner are that he had pledged 2.680 tolas of gold items with complainant firm namely UAE, Exchange and Financial Services Limited VINEET GULATI 2016.07.23 15:10 I attest to the accuracy and authenticity of this document Chandigarh for obtaining a loan of `47,000/- and it is alleged that gold was impure.

CRM No.M-10955 of 2016 -2Learned counsel for the petitioner argued that no offence is made out as the complainant-firm had issued certificate after satisfying itself regarding purity of gold.

The petitioner has already joined the investigation. He is no more required for custodial interrogation. The petitioner has not misused the benefit of interim bail since 31.03.2016. No useful purpose will be served by sending the petitioner to custody.

Keeping in view the facts and circumstances of the case and without discussing the facts of the case in minute details and without expressing any opinion on the merits of the case, I find it a fit case, where the petitioner is entitled to benefit of grant of anticipatory bail. Therefore, the present petition is accepted and the order dated 31.03.2016 granting interim bail to the petitioner is made absolute.
