1.

The prayer in the present Civil Writ Petition filed under Articles 226/227 of the Constitution of India, is for directing the respondents to consider the case of the petitioner who had applied for the post of DPE as per the advertisement (Annexure P-1) in general category but was denied appointment due to shifting of SC/ST/OBC/FF/Sports/ESM in General Category.

Learned State counsel referred to counter affidavit dated 30.07.2020 filed on behalf of respondent Nos. 1 to 4, of which para No. 3 of preliminary submission reads as under:-

3. That the scrutiny of documents of the all the candidates as well as of the petitioner was conducted by Education Recruitment Directorate and scrutiny committee was constituted for scrutiny. That the merit for the post of DPE in the present petition is prepared strictly on the basis Instructions No. 1/35/2017 RC/1071544/1 dated 25.09.2017 (Annexure P-6) and no reserve category candidate having availed any kind of relaxation in age or marks except fees Gaurav Arora 2024.03.07 17:47 I attest to the accuracy and integrity of this document

has been considered in the General category. Such candidates have been considered in their respective reserve category.

In view of the aforesaid, there is no merit in the present writ petition and the same is dismissed.
