(Presence marked through video conference.) ARUN MONGA, J. (ORAL) Petitioner herein, inter alia, seeks issuance of a writ in the nature of mandamus directing the respondent-Commission to belatedly grant her an opportunity to appear for the document verification as she had successfully participated in the selection process up to the round of document verification.

Learned counsel for the petitioner submits that petitioner lives in a backward area with no proper facility of internet. She was unaware about the notice issued for document verification, therefore, she could not appear for the same on the scheduled date. He submits that petitioner qua her aforesaid grievance submitted a representation dated 09.12.2020, but to no avail. Hence, the instant petition.

On advance service, learned State counsel joins proceedings and strenuously opposes issuance of notice. He argues that notice for document verification was issued way back in the year, 2018 and petition. He is liable to be dismissed on this ground alone. 4.

I have heard learned counsel for the parties and perused the paper book.

On a Court query, no plausible reasoning has come forth with regard to the delay either in course of arguments and/or even in the pleadings. No interference of this Court is called for in exercise of its extraordinary writ jurisdiction at this stage. 6.

Writ petition is, accordingly, dismissed on the ground of delay and laches.

However, in case the department may like to have a compassionate view given the mitigating circumstances, as more particularly enumerated in the petition, instant dismissal shall not come in the way of taking a fresh look and pass an appropriate orders, provided the petitioner is found competent and meritorious.
