MADAAN Present:- Mr. Vivek Salathia, Advocate for the applicant. *** In this case, according to the applicant, she is having custody of minor son Master Vihaant Aggarwal and that she is putting up at Ajnala, District Amritsar. Her husband Nikhil Aggarwal has filed a petition for custody of the minor son in the Court of Ms. Preeti Sahni, Additional District Judge, Family Court. Jalandhar.

In terms of Section 9 of the Guardians and Wards Act only the District Court having jurisdiction in the place where the minor ordinarily resides can entertain and try the petition under Section 25 of the Guardians and Wards Act, 1890.

The applicant is relegated to the remedy of approaching the trial Court by moving an appropriate application seeking return of petition to the Court of competent jurisdiction at Jalandhar.
