Petitioner has filed this second petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.55 dated 15.08.2014 under Sections 364 and 120-B IPC registered at Police Station Phul District Bathinda.
Notice of motion was issued and learned State counsel appeared and contested the petition.
Learned counsel for the petitioner argued that the main accused Gurjit Kaur has already been released on bail by the Coordinate Bench as per the order dated 19.03.2015. I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. CRM No.M-10014 of 2015 -2As per the prosecution version, Gurtej Singh, younger son of the complainant, has been missing since 25.05.2014 and he could not be located. The allegations are that Gurtej Singh went to the house of Gurjit Kaur as there was suspicion regarding illicit relations and then a suspicion was raised by the complainant that Gurtej Singh might have been killed. The challan has been presented against Gurjit Kaur and Inder Pal Singh under Sections 364 and 120-B IPC. The present petitioner is stated to be friend of Gurpreet Singh, who is brother of Gurjit Kaur.
As the main accused Gurjit Kaur has been released on bail by this Court, therefore, on the ground of parity, present petitioner is also entitled to grant of benefit of regular bail. Keeping in view the facts and circumstances of the case and without discussing the merits of the case in minute details and without expressing any opinion on the merit of the case, the present petition is accepted and the petitioner is ordered to be released on regular bail on furnishing bail bonds in the sum of `50,000/- with one surety in the like amount to the satisfaction of the learned trial Court/Duty Court, Bathinda.
