Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner(s) in case FIR No. 41 dated 01.04.2017, registered under Section(s) 379 IPC and Section 21 of the Mines and Minerals (Development and Regulation) Act, 1957 at Police Station Subhanpur, District Kapurthala.

Learned counsel for the petitioner contended that petitioner was earlier admitted to bail in this case and he had been regularly appearing before the learned trial Court, however, his bail was cancelled as he failed to appear in the Court on 10.01.2019 because of his illness. Learned counsel further contended that petitioner is ready to surrender before the learned trial Court and furnish fresh bail bonds as well.

Criminal Misc. No. M-7390 of 2019 Advocate General, Punjab accepts notice on behalf of respondent. A copy of paper-book be provided to him during the course of the day. In view of above, present petition stands disposed of with the directions that petitioner will surrender before the learned trial Court within a period of one week from today and on his moving an application for grant of fresh bail, the trial Judge shall release him on bail on his furnishing fresh bail bonds and surety bonds. However, the learned trial Judge shall be at liberty to complete the proceedings under Section 446 Cr.P.C. against the petitioner.
