(ORAL) Prayer in the instant petition under Section 438 Cr.P.C. has been made for grant of anticipatory bail to the petitioner, in case, FIR No.207 dated 26.07.2018, registered under Section 379 IPC and Section 21 of Mines and Minerals (Development and Regulation) Act, 1957, Police Station Phillaur, District Jalandhar. According to the prosecution, petitioner along with his accomplice is indulged in illegal mining of sand. The police raided the disclosed place on the basis of secret information and recovered 03 tippers loaded with sand, tractor trollies without number loaded with sand extracted illegally.

Learned counsel for the petitioner contends that petitioner is not the owner of any vehicle taken into possession by the police from the spot. The petitioner is innocent.
