Main case Prayer is for grant of regular bail to accused-petitioner Devender Singh in case FIR No.1452 dated 25.11.2015 under Sections 420,467,468,471,120-B IPC, PS City Gurgaon.

CRM-M 11018/2016(O&M) 116+229 Revenue Section of the complainant-company and he master minded a transaction whereby qua a portion of the licensed land a lease deed dated 24.4.2014 came upon to be executed for a sum of Rs.30,000/- for a period of thirty years thereby causing severe prejudice to the interest of the complainant-company.

Apart from merits, it is contended that petitioner is in custody since 23.12.2015 and after completion of investigation,primarily based on documents, challan stands presented against him. The case is triable by a Magistrate and evidence of 9 cited witnesses is yet to commence.

Learned State counsel, on instructions, is unable to refute the aforesaid factual situation.

Learned counsel for the complainant states that parties are in the process of negotiating amicable settlement and does not oppose the grant of regular bail.

In view of the above,without commenting upon the merits of the case present petition is allowed and accused petitioner is directed to be released on bail to the satisfaction of CJM/Duty Magistrate,Gurgaon.

Disposed of.
