(ORAL) Prayer in the instant petition under Section 438 Cr.P.C. has been made for grant of anticipatory bail to the petitioner, in case, FIR No.10727 dated 26.10.2017, registered under Sections 135 and 151 of Indian Electricity (Supply) Act 2003, Police Station I & P PS Karnal, District Karnal.

According to the prosecution, on 24.10.2017, the petitioner was found committed theft of electricity energy, causing loss to UHBVNL, Assandh, which was assessed as `2,33,158/- according to the electricity sales circular & regulations. Earlier, the petitioner was granted opportunity to deposit 40% of the aforesaid theft amount of electricity energy by Civil Court in a civil suit by him, but he did not comply with the said order. Therefore, the petitioner himself invited trouble for him. CRM-M-7418 of 2019 --2-- petitioner is not able to pay the aforesaid amount of electricity theft. Since, the petitioner has committed theft of electricity energy by extracting the same by illegal means, therefore, this Court is not inclined to grant anticipatory bail.
