The petitioners apprehend arrest in a case registered at the instance of Manjeet Singh alleging that on 26.11.2015 when he along with his brother Gurvinder Singh was standing out side his house, the petitioners along with Amritpal Singh and few others, armed with gandsa, kapa, sticks etc. came there and attacked the complainant and his brother and assaulted them by causing grievous injuries. So far as petitioner No.1 Darbara Singh is concerned, he is attributed a lalkara and a gandsa blow, which has hit on the back of Gurvinder Singh. Petitioner No.2 Pargat Singh is attributed a kapa blow on the middle finger of left hand of complainant, whereas petitioner No.3 Balkar Singh is also attributed an injury with a dang, which hit on the little finger of left hand of Manjit singh. Petitioner No.3 has also been attributed an injury on the left side of head of the complainant. After hearing counsel for the parties and going through the police file, it appears that all the petitioners have been attributed simple injuries.
Cr. Misc. M 11022 of 2016 In view of the fact that no grievous injury is attributed to the petitioners and they have joined the investigation and on account of there being earlier enmity between the parties, the petitioners can be granted the concession of pre-arrest bail.
Accordingly, the petition is allowed and it is ordered that in case of arrest of the petitioners, they will be released on bail to the satisfaction of the arresting officer subject to the condition that they will join the investigation as and when required by the police and will not tamper with evidence or hamper the investigation. The petitioners will not commit the similar offence, of which they are accused of, during pendency of the trial.
