(ORAL) By way of this petition, the petitioner has approached this Court for seeking the relief of issuance of a writ in the nature of mandamus directing the respondents to grant him the benefit of 2nd ACP which became due to him on 04.07.2010 after completion of 20 years of service and to re-fix his pension accordingly and to pay all the consequential benefits to him along-with interest thereon at the rate of 24% per annum, while averring that the respondents have illegally deprived him of the said benefit despite his having become eligible for the same with effect from the afore-said date and though, he has already served a legal notice dated 16.12.2020 (Annexure P-7) upon the respondents in this regard but in vain. Learned counsel for the petitioner submits that the petitioner would be satisfied in case a direction is issued to respondent No.2 to look into and deal with/decide his said legal notice dated 16.12.2020 (Annexure P-7) within some specific time-frame.

Keeping in view the afore-discussed limited prayer of learned counsel for the petitioner and without commenting upon the merits of the matter in hand, the present writ petition is hereby disposed of with a direction to respondent No.2-Chief Engineer, Uttar Haryana Bijli Vitran Nigam, to look into the said legal notice of the petitioner dated 16.12.2020 (Annexure P-7) and to decide/deal with the same in accordance with law/Rules, by passing a speaking order thereon, within a period of three months from the date of receipt of the certified copy of this order.
