RAMENDRA JAIN, J. (ORAL) Through this petition under Section 439 Cr.P.C., prayer has been made for grant of regular bail to the petitioner in case FIR No. 170 dated 07.07.2018 registered under Section 22 of the NDPS Act at Police Station Talwandi Sabo, District Bathinda.

According to the prosecution, the petitioner along with his co-accused-Gurpreet Singh, was apprehended with conscious possession of 700 tablets of Tredol.

Learned counsel inter alia contends that co-accused of the petitioner, namely; Gurpreet Singh, has already been granted the regular bail by this Court, vide order dated 14.01.2019 (Annexure P-3) passed in CRM-M-51343-2018. Therefore, treating the case of the petitioner on the same parity, he may also be granted the concession of regular bail. On the other hand, learned State counsel vehemently, refuting the submissions of learned counsel for the petitioners contends RISHU KATARIA 2019.03.06 13:21 I attest to the accuracy and integrity of this document

CRM-M-7995-2019 -2that co-accused of the petitioner was granted bail, because he is a mentally retarded person to the extent of 40%, besides having permanent disability to the extent of 50%. Therefore, the case of the petitioner cannot be treated on the same parity.

Considering, the seriousness of allegations levelled against the petitioner and the fact that by this time, the petitioner had suffered a very short confinement, this Court is not inclined to grant bail to the petitioner. More so, drug trafficking in this Northern region of the country has increased manifold in the recent past and, thus, such type of crime has to be dealt with severe hands.

Dismissed.
