BEDI, J (ORAL) Petitioners seeks concession of regular bail in a case registered at the instance of Pargat Singh, alleging that on 20.12.2015 when the complainant was going towards Jammu along with his brother Nishan Singh after loading consignment in his Bolero car, 3/4 boys started throwing stones on the vehicle, as a result of which, the vehicle had gone out of control and hit a wall. The accused persons started beating the complainant with sticks and caused injuries and snatched his wallet and ATM cards.
So far as the petitioners are concerned, they are not named in the FIR but were involved in another case under Section 399 IPC. They had allegedly made confessional KAPIL 2016.06.03 16:48 I attest to the accuracy and authenticity of this document

The question whether the statements made by the petitioners in another case regarding their involvement in the present case, is an admissible piece of evidence, would be a debatable issue during trial. Challan has already been presented. The trial is likely to take long time. Petition is allowed. Petitioners are ordered to be released on bail on their furnishing bail bonds/surety bonds to the satisfaction of the trial Court.
