This petition has been filed under Section 482 Cr.P.C. seeking quashing of FIR No.316 dated 11.07.2019 under Sections 120-B, 34, 406, 420, 467, 468, 471 and 506 of IPC registered at Rajendra park Police Station Gurugram (Annexure P-1) along with all subsequent proceedings arising therefrom.

Learned Senior Counsel for the petitioner submits that the petition was initially filed seeking quashing of the FIR. On 04.09.2025, learned Senior Counsel further submitted that during the pendency of the petition, the parties have amicably settled their dispute and in this regard, the complainant had furnished an affidavit (Anneuxre P-15) stating that he has no objection to the
-2quashing of the FIR in question, subject to the condition that the builder shall not raise any objection regarding the transfer of the flat to be allotted to him in favour of a third party/proposed buyer.

Pursuant to the aforesaid order, parties have appeared before the learned Judicial Magistrate 1st Class, Gurugram and got their statements recorded. On the basis of the statements so recorded, learned Magistrate has submitted copy of report dated 04.11.2025 to the effect that the compromise has been effected between the parties voluntarily and without any coercion or undue influence.

Learned State counsel as well as counsel for respondent No.2 have not disputed the factum of compromise between the parties.Learned counsel for the petitioner has produced a photocopy of receipt of payment of Rs. 50,000/- in the Court today and the same is taken on record. 6.
In view of the above, no useful purpose would be served to continue with the proceedings before the trial Court in the instant FIR. 7.
Following the principles laid down by the Full Bench judgment of this Court in Kulwinder Singh and others Versus State of Punjab and another 2007 (3) RCR (Criminal) 1052 and approved by the Hon'ble Supreme Court in Gian Singh Versus State of Punjab and others (2012) 10
-3SCC 303, this petition is allowed and FIR No.316 dated 11.07.2019 under Sections 120-B, 34, 406, 420, 467, 468, 471 and 506 of IPC registered at Rajendra park Police Station Gurugram (Annexure P-1) and all subsequent proceedings arising therefrom are quashed qua the petitioners.
