The prayer in the present writ petition is for issuance of directions to respondent Nos.1 and 2 to grant proportionate pension to the petitioner for the services rendered from 01.10.1983 to 31.12.2003 as Staff Nurse under respondent No.4 before joining her service as Demonstrator under respondent No.3.
Learned counsel for the petitioner would contend that similarly situated employees have been given the benefit. Learned counsel would further contend that in this regard a representation dated 04.11.2020 (Annexure P-13) has been sent to respondent No.2 (Director Medical Education and Research, Punjab). However, no decision has been taken on the same. On the asking of the Court, Ms. Ambika Bedi, AAG, Punjab has put in appearance through video conferencing and accepts notice on behalf of respondent Nos.1, 2 and 5 while Mr. Naresh Kumar, Advocate, has put in appearance on behalf of respondent No.3 through video conferencing and accepts notice.
Since the matter is not being decided on merits, service upon respondent No.4 is dispensed with.
I have heard the learned counsel for the parties. In view of the limited prayer made by the learned counsel for the petitioner and without commenting on the merits of the case, the present writ petition is disposed off with a direction to respondent No. 2 - Director Medical Education and Research, Punjab - to take a decision, in accordance with law, on the representation dated 04.11.2020 (Annexure P-13) given by the petitioner within a period of two months from the date of receipt of certified copy of this order.
