SURESHWAR THAKUR, J Learned counsel for the appellant submits that since the petition filed under Section 13 of Hindu Marriage Act, 1955 before the Family Court, has been decided, therefore, the present petition challenging the impugned order passed on the application filed under Section 24 of the Act, thus has been rendered infructuous, therefore, learned counsel for the appellant seeks and is permitted to withdraw the instant appeal.

Dismissed as withdrawn. Liberty, if any is reserved to the appellant, to in case the said order remains unexecuted, thus file an execution petition before the court of first instance.
