(ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to the petitioner, in case, FIR No.01 dated 06.01.2019, registered under Sections 307, 365, 341, 323, 325, 295, 506, 148, 149, 120-B IPC and Section 25 of the Arms Act, 1959, Police Station Sehna, District Barnala.

According to the prosecution, on 06.01.2019, petitioner and his 6 accomplice armed with deadly weapons like iron rod, pistol, baseball bat, sticks etc. cordoned the complainant and opened attack , causing multiple injuries including grievous one with an intention to kill him.

CRM-M-7987 of 2019 --2-- IPC is not made out against the petitioner, as there is no medical record that any of the injuries suffered by the complainant is dangerous to life. The petitioner is in custody since 15.01.2019. Filing of final report and conclusion of trial may take sufficient time. No useful purpose would be served by detaining the petitioner in jail any more. On the other hand, learned State counsel vehemently opposing the grant of bail to the petitioner contends that on 30.12.2018, one week earlier to the present incident, complainant had won the election of village Sarpanch against the father of the petitioner. Therefore, to take revenge, the petitioner and his accomplice fractured the leg of the complainant, committing offence under Section 325 IPC. Considering the seriousness of allegations, this Court is not inclined to grant regular bail to the petitioner, inasmuch as, he may tamper with the evidence.

Dismissed.
