(ORAL) Prayer in this petition filed under Section 482 Cr.P.C. is for quashing FIR No. 15 dated 24.02.2018 (Annexure P-4) registered under Sections 363, 366-A and 120-B IPC at Police Station Jhabal and all the consequential proceedings arising therefrom, qua the petitioners. At the outset, learned counsel for the petitioners submits that now, the matter has been compromised between the parties. Petitioner No. 1-Davinder Singh and petitioner No. 2-Gurleen Kaur, are already married and a child was also born out of the said wedlock. Mr. Gurdeep Singh, Advocate for Mr. Pardeep, Advocate, has put in appearance on behalf of respondent No. 2-complainant and filed memo of appearance in the Court today, the same is taken on record. Learned counsel for respondent No. 2 does not dispute the RISHU KATARIA 2023.08.11 17:28 I attest to the accuracy and authenticity of this order/judgment
CRM-M-11105-2018 -22023:PHHC:103431 aforesaid fact and admits the factum of compromise between the parties. He further submits that respondent No. 2-complainant does not want to pursue further with the impugned FIR. He also submits that he has no objection, in case, the present petition is allowed and FIR No. 15 dated 24.02.2018 (Annexure P-4), is quashed.
Even learned counsel for the State, on instructions submits that petitioner No. 2-Gurleen Kaur, has solemnized marriage with petitioner No. 1-Davinder Singh and they both are living together happily as husband and wife.
Since the matter has been settled and the parties have decided to live in peace, this Court feels that in order to secure the ends of justice, the criminal proceedings deserve to be quashed. In view of what has been discussed here-in-above, this petition is allowed and FIR No. 15 dated 24.02.2018 (Annexure P-4) registered under Sections 363, 366-A and 120-B IPC at Police Station Jhabal, along with all other consequential proceedings arising therefrom, are ordered to be quashed qua the petitioners.
