The petitioners are the defendants in a suit for recovery of an amount of 48,30,131/-. The trial Court, after dismissing the application ₹ under Order VII Rule 11 CPC on 21.12.2021, has struck off the defence of the petitioners vide an order dated 05.01.2022. 2.

The learned counsel representing the petitioners inter alia contends that due to the spread of the COVID-19 pandemic, the Courts did not function in a normal manner. He submits that the courts were working in a restricted manner during the last two years. He submits that the application, filed by the defendants under Order VII Rule 11 CPC, was dismissed on 21.12.2021.

Keeping in view the aforesaid facts, it is considered appropriate to grant one last opportunity to the petitioners to file their written statement, subject to payment of costs of 5,000/-. The written statement be filed by the ₹ defendants, in the suit, within a period of ten days, from today, along with DEEPAK KUMAR BHARDWAJ 2022.03.10 10:49 I attest to the accuracy and integrity of this document
