PRESENT: MR. R.D. YADAV, ADVOCATE FOR THE APPELLANTS. MANOJ BAJAJ, J.(ORAL) The appellants(defendants) have preferred this regular second appeal to challenge the judgment and decree dated 25.1.2021, passed in Civil appeal No.473 of 2018, by the first appellate Court, whereby it has affirmed the judgment and decree dated 18.10.2018, passed by Addl.Civil Judge (Sr.Divn.) Rewari, allowing plaintiffs' suit for possession. Learned counsel for the appellants-defendants states that he does not press this regular second appeal on merits and prays that time be afforded to him to remove the construction from the suit property. During the course of hearing, it is not disputed that the through the impugned decree, the defendants have been directed to remove the construction raised by them in the suit property and this aspect, can be dealt with by the Executing Court, as the warrants of possession have been issued against the appellants-judgement debtors.

The appeal is dismissed as not pressed.
