Petitioners have filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.93 dated 06.08.2016 under Sections 10, 11, 13, 17, 19, 38, 39 of the Unlawful Activities (Prevention) Act, 1967 and Section 25 of the Arms Act, registered at Police Station Chabbewal, District Hoshiarpur.

Notice of motion was issued. Learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that FIR in the present case has been registered on receiving some reliable information that Harjap Singh and

CRM No.M-10293 of 2017 -2Avtar Singh, are active members of Khalistan Liberation Force, which has been declared illegal under Section 21 and 35 of Unlawful Activities (Prevention) Act, 1967 and is disallowed. The above-mentioned persons by preaching false and imaginary stories incite the young and innocent people and want to revive terrorism. Harjap Singh and Avtar Singh contacted Jaspreet Singh @ Jassa, Hardeep Singh @ Deepa, Kuldeep Singh @ Deep, Bikramjit Singh, Balwinder Singh Bittu, through facebook and telephone and are making them to collect arms, ammunition and explosives in huge quantity. As per the report under Section 173 Cr.P.C.

, one pistol made in Peshawar along with two life cartridges were recovered from Jaspreet Singh @ Jassa and 20 books were also recovered relating to atrocities on Sikhs and one black coloured pistol made in Italy was also recovered; from accused Hardeep Singh, one black coloured pistol made in Zastauva along with two live cartridges was recovered; 5(five) T-shirts from Hardeep Singh and 10(ten) T-shirts from Kuldeep Singh @ Deep in front side of which 'PUNJAB INDEPENDENCE DAY REFERENDUM 2020' is written and photo of Jarnail Singh Bhindrawala has been printed and on the back side, sign of 'Khanda' and 'REFERENDUM 2020' has been written, were recovered and 200 grams of explosive material potassium sulphate was also got recovered from Hardeep Singh. From Bikramjit Singh @ Bikka, 40 live cartridges were recovered.

The challan in the present case has already been presented. Even the charge-sheet has also been served against the petitioners. Keeping in view the facts and circumstances of the present case, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, in view of the nature and gravity of

CRM No.M-10293 of 2017 -3the offence and in view of the fact that case is at preliminary stage, I do not find it a fit case where petitioners are entitled to benefit of regular bail. Therefore, finding no merit in the present petition, the same dismissed.
