(Oral) The allegations against petitioner Davinder Singh @ Bhola in this anticipatory bail application as well as in supplementary bail application are that on 3.9.2014 around 11.15 AM he along with 6/7 other persons had assaulted complainant Baljit Singh. It has been brought to the notice of this Court by the State counsel on instructions from ASI Nirbhay Singh, Police Station Shimlapuri, District Ludhiana that only two injuries are attributed to the petitioner by means of iron Datt, one on the left lower arm which is opined to be sharp grievous injury and the other simple injury on the left leg.

Criminal Misc. No. M-10261 of 2015 -2complainant side has also been registered at the behest of the petitioner side regarding causing injuries to them.

Without feeling the necessity of adverting to the merits of the case, at this juncture it is not possible to decide as to which of the party was the aggressor. Moreover the lone grievous injury is on the non-vital part. In the event of arrest, the petitioner shall be released on bail to the satisfaction of arresting/investigating officer till submission of report under Section 173 Cr.P.C. (challan). Thereafter, petitioner will be permitted to furnish regular bail bonds to the satisfaction of the trial Court. The petitioner shall, however, join the investigation as and when called for and shall also abide by the conditions specified under section 438 (2) Cr.P.C. Presently the petitioner is directed to join the investigation within 10 days. The present petition stands disposed off.
