PANKAJ JAIN, J. (ORAL) By way of present writ petition filed under Article 226/227 of the Constitution of India, petitioner prays for writ in the nature of mandamus directing the respondents to remove the pay anomaly and to fix the pay of the petitioner at par with his colleague in General Category namely Balbir Singh and grant him revised retiral benefits along with arrears and interest.

Counsel for the petitioner contends that even though the claim of the petitioner has been recommended vide Annexure P-6 yet final decision thereon has not been taken.

On advance notice, Mr. Bhupinder Banga, Advocate appears for Mr. Tushaar Madaan, Advocate and submits that the claim of the DEEPAK KUMAR 2023.03.14 17:35 I attest to the accuracy and integrity of this document

CWP No.3884 of 2023 -2petitioner is under consideration and final call shall be taken within a period of six weeks from the date of receipt of certified copy of this order. Finding it to be a fair request, the present writ petition is disposed off with a direction to the respondents to consider the claim of the petitioner as recommended vide Annexure P-6 within the aforesaid period. In case the petitioner is found to be entitled, necessary relief be released within eight weeks thereafter.

However, in case the respondents are of the opinion that the claim of the petitioner merits rejection the same be adjudicated by passing a speaking order after granting opportunity of personal hearing to the petitioner.
