JASGURPREET SINGH PURI , J. (Oral) The present petition has been filed under Section 482 Cr.P.C. for issuance of direction to respondents to take action against the accused persons who have fabricated the agreement to sell and received Rs.1 Crore.
Learned counsel for the petitioner has submitted that the petitioner is power of attorney holder of his daughters and the petitioner is residing in USA and his daughters are residing in Canada and they have never visited India and at their back their property/agricultural land was usurped by the accused persons by fabricating the agreement to sell and received Rs.1 Crore. CRM-M-9884-2022 (O&M) complaint vide Annexure P1 was filed before the Senior Superintendent of Police, Mohali, then the same was entrusted to the DSP for inquiry but till date no action has been taken by the DSP although the petitioner has joined the inquiry and supplied all the documents to the DSP. Notice of motion to respondent Nos.1, 2 and 3 only. Mr.C.L.Pawar, Sr. DAG, Punjab, accepts notice on behalf of the aforesaid respondents and states that he has no objection in case representation/complaint (Annexure P-1) is directed to be looked into by the SSP concerned, in a time bound manner, in accordance with law. I have heard the learned counsel for the parties. The petitioner had filed a representation/complaint (Annexure P-1) with the Senior Superintendent of Police, Mohali dated 11.12.
2021 and according to the learned counsel for the petitioner the same was entrusted to the DSP, Mohali, but no action has been taken. In view of the averments made in the petition and the representation/complaint (Annexure P-1) as well as the stand taken by the learned State counsel, this petition is disposed of with a direction to the Senior Superintendent of Police, Mohali, to look into representation/complaint (Annexure P-1) within a period of six weeks from the date of receipt of copy of the order and in case so required, then thereafter, proceed further in accordance with law.
