(ORAL) Prayer in the instant petition under Section 482 Cr.P.C. has been made for quashing FIR No. 70 dated 05.04.2012 (Annexure P-1) registered under Sections 452, 324, 323, 506, 148, 149 IPC (later on Section 324 IPC was deleted and Section 326 IPC was added) at Police Station Dakha, District Ludhiana (Rural) and all subsequent proceedings arising therefrom, on the basis of compromise dated 17.11.2018 (Annexures P-3 and P-4) effected in between the parties. Pursuant to order dated 23.10.2018 of this Court, the parties appeared before the Judicial Magistrate Ist Class, Ludhiana, on 04.12.2018 to get their statements recorded. Learned Judicial Magistrate Ist Class, Ludhiana, has submitted his report vide letter No. 185 dated RISHU KATARIA 2019.02.25 18:45 I attest to the accuracy and integrity of this document
CRM-M-11187-2018 -213.12.2018, duly forwarded by learned District and Sessions Judge, Ludhiana, vide letter No. 1145/EC dated 15.12.2018. According to the report, learned Judicial Magistrate Ist Class, Ludhiana, is satisfied that compromise effected between the parties is without any pressure and with their free will. No accused has been declared as proclaimed offender.
In compliance of order dated 30.01.2019, original receipts regarding deposit of costs of ` 15,000/- have also been produced in Court today. The same are taken on record. Be tagged at appropriate place. Considering the report of learned Judicial Magistrate Ist Class, Ludhiana dated 13.12.2018 and deposit of costs as well as the fact that the compromise will bring peace and harmony in relations between the parties, aforesaid FIR No. 70 dated 05.04.2012 (Annexure P-1) along with all subsequent proceedings arising therefrom, is quashed qua the petitioners only.
