RAMENDRA JAIN, J. (ORAL) Through this petition under Section 439 Cr.P.C., petitionerPritam Singh @ Raju, has prayed for grant of regular bail in case FIR No. 412 dated 29.11.2019 registered under Section 17 of the NDPS Act, Police Station Civil Line, Sirsa.

According to prosecution, on 29.11.2019 the petitioner was apprehended by the police for keeping 280 grams heroin wrapped in a glazed paper in right pocket of his pant.

Learned counsel inter alia contends that petitioner has falsely been implicated in the instant case. Recovery of contraband effected from the petitioner falls under the definition of 'non-commercial quantity'. The petitioner is in custody since 29.11.2019. Conclusion of trial may take a long time. No useful purpose would be served by detaining the petitioner in jail.

CRM-M-7665-2020 -2On the other hand, learned State counsel vehemently opposed the submissions of learned counsel for the petitioner. Considering overall facts and circumstances, but without expressing any opinion on the merits of case, the petition is allowed. Consequently, petitioner-Pritam Singh @ Raju, is ordered to be released on bail pending trial, if, not required in any other case, on his furnishing adequate bail and surety bonds to the satisfaction of trial Court/Duty Magistrate, concerned.
