The present petition has been preferred under Article 226 of the Constitution of India for grant of emergency parole for a period of four weeks to the petitioner under the provisions of Haryana Good Conduct of Prisoners (Temporary Release) Act, 1988 to enable the petitioner to attend the last rites of his deceased mother, which is to be held on 12.02.2025. 2.
Learned counsel for the petitioner submits that the petitioner was initially permitted to attend the cremation of his mother but due to imposition of Code of Conduct, the request for grant of emergency parole to the petitioner was not considered. Learned counsel submits that now the bhog ceremony of mother of the petitioner is to be held on 12.02.2025 and prays for grant of emergency parole.

After arguing for some time, at this stage, learned counsel for the petitioner does not press the instant petition with liberty to the petitioner SANDAL SHARMA 2025.02.11 10:40 I attest to the accuracy and authenticity of this order/judgment
CRWP-1407-2025 (O&M) -2- to move an appropriate application before respondent No.4-Superintendent, District Jail Gurugram for seeking emergency parole for the purpose of attending the bhog ceremony of his deceased mother, which is to be held on 12.02.2025, and prays that directions may be issued to respondent No.4 to decide the representation/application of the petitioner expeditiously. 4.

On the asking of the Court, Mr. Ramender Singh Chauhan, AAG Haryana accepts notice on behalf of respondent-State and submits that the application/representation of the petitioner will be considered in accordance with Haryana Good Conduct of Prisoners (Temporary Release) Act, 1988 in an expeditious manner.

In view of the limited prayer made by learned counsel for the petitioner, the present petition is dismissed as withdrawn with liberty to move an appropriate application before respondent No.4 in accordance with law.

Needless to say that if such an application/representation is moved, respondent No.4 is expected to consider and dispose of the same expeditiously in accordance with law, considering the fact that bhog ceremony of the mother of the petitioner is scheduled for 12.02.2025.
