The petitioner is seeking regular bail in FIR No.126 dated 09.06.2015, registered under Sections 304 and 34 IPC, Police Station Fatehgarh Sahib.

Heard.

The deceased was in a live2in relation with the petitioner for over a year. She went back to her parents' house on 05.06.2015 and died on 09.06.2015. Poison was detected in the viscera. The counsel for the petitioner urges that the death had taken place in the parents' house and had anything been administered to the girl on 05.06.2015, she would have been taken to the hospital on that very day. He further urges that it is a cover up and could be a case of honour killing.

The petitioner is in custody since 19.07.2015. The investigation stage is over and challan has been filed. Charge has not been framed. The allegations in the FIR were that the deceased was not given food and she had become physically weak and remained ill. However, in the viscera poison was found and the deceased was with her parents when the poison was administered. Without commenting upon the merits of the case, the petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal and surety bonds to the satisfaction of the trial Court/Duty Magistrate, Fatehgarh Sahib.
