The petitioner, by filing the present petition cast under Section 438 Cr.P.C., seeks grant of anticipatory bail in case FIR No. 0012 of 12.01.2022, which was registered against him, at Police Station Ambala City, District Ambala, constituting therein an offence under Section 174-A of the Indian Penal Code.

This Court, through an order made on 07.03.2022, had granted ad interim bail to the bail applicant / petitioner. 3.

The learned State Counsel, on instructions, meted to him, by ASI Shamsher Singh, submits that the bail applicant - petitioner, has participated in the relevant investigations, and, also submits that he is rendering his fullest cooperation to the IO concerned. He further submits that very soon, a report under Section 173 of the Cr.P.C., would become instituted, by the IO concerned, before the learned trial Magistrate concerned.

Given the above, and, when in respect of the afore offence, no DINESH KUMAR 2022.05.06 18:26 I attest to the accuracy and authenticity of this document recoveries are to be effected, at the instance of the petitioner, and besides,

CRM-M No. 9419 of 2022 -2when also no evidence has been adduced by the prosecution, that in the event of the bail applicant being enlarged on pre-arrest bail, there is every likelihood of his fleeing from justice, and, or, tampering with prosecution evidence. Therefore, this Court does not deem it fit to order for the custodial interrogation of the bail petitioner. 5.

Consequently, this Court makes absolute the order made by this Court on 07.03.2022. However, the making of absolute of the afore order shall be subject to the terms and conditions of the order (supra). 6.

Disposed of.
