(Oral) (1) The petitioner seeks ad interim bail in case FIR No.92 dated 03.06.2014 under Sections 21/22/25/25-A/27/29/61/85 of the NDPS Act read with Section 26/54/59 of the Arms Act registered at Police Station Pasiana, District Patiala on the ground that her mother and wife require immediate medical assistance as they are suffering from serious ailments.
(2) In deference to the previous order dated 02.03.2016, the Senior Superintendent of Police, Barnala has filed his affidavit in which it is averred that the Civil Surgeon Barnala vide memo dated 14.03.2016 has informed that the mother of the petitioner was taken to Dayanand Medical College at Ludhiana for examination by the Gastroenterology Department for taking expert opinion of the organ transplant surgeon regarding her further treatment and any surgical intervention, if needed. and her husband were not willing to undergo such tests and as per the advice of the doctors, the patient can be presently treated as OPD patient only. The report of the Civil Surgeon, Barnala is appended with the affidavit which does indicate that the parents of the petitioner did not cooperate with the medical investigation for surveillance assessment as was recommended by the subject specialists.
(3) In this view of the matter, the hue and cry made by the petitioner in the petition that he is required to be released on interim bail to arrange and look after the surgery of his mother does not inspire any confidence. We thus decline to release the petitioner on bail and dismiss the petition, however, with a direction to the Civil Surgeon, Barnala to provide an Emergency Medical Assistance No. to the parents of the petitioner so that in the event of any need, at any time, adequate medical assistance can be provided to them at the State expenses. (4) Ordered accordingly.
