The petitioner has prayed for his release on bail in terms of the provisions of Section 438 Cr.P.C. in a case registered vide F.I.R. No.140 dated 20.9.2013 under Sections 21,61,85 of the N.D.P.S. Act and Section 61 of the Punjab Excise Act at Police Station Shaheed Bhagat Singh Nagar, Nawanshehr as he had committed a default in appearance before the learned trial Court. Criminal Misc. No.M-10392 of 2015 -2the trial Court on the date fixed before it i.e. 27.4.2015. Today, when the matter has been taken up, learned counsel for the petitioner pleads no instructions.

If that be so, the petition is disposed of with a direction to the trial Court that in case the petitioner has not surrendered before it as per the mandate of the order dated 7.4.2015, it shall proceed against him in accordance with law by carrying out the execution of the non bailable warrants and submit the petitioner to arrest.
