The petitioner seeks the concession of pre-arrest bail in a case registered at the instance of Manoj, Clerk in the office of District Welfare Council, Narnaul alleging that on 16.2.2016 one boy named Mohit approached him with a request to change the date of medical slip submitted for driving licence. The complainant, on perusal of the medical slip and form became suspicious and found that the medical certificate appended with the form was fictitious, alleged to have been signed by Mukesh Goel, Medical Practitioner . Mohit had disclosed that the forged receipt of driving licence and medical test certificate had been handed over to him by none else but the petitioner.

Counsel for the petitioner submits that the petitioner has been falsely implicated in the case and that he is working in the Tehsil premises just to sell the different forms.

I have heard counsel for the parties and gone through the police file. Mohit, who has submitted an application for getting the driving licence, does not seem to have any motive to falsely implicate the petitioner. It may be a case of no recovery but at the same time the act of the petitioner in facilitating the fake driving licence, which could result in far reaching consequences, no extra ordinary exceptional circumstances exist to grant the concession of pre-arrest bail to the petitioner, lest it should perpetuate corruption and illegality.

Dismissed without prejudice to the right of the petitioner to seek the concession of regular bail.
