On 25.02.2026 following order was passed:- 1.
The petitioner has filed the instant petition under 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail in FIR No.212 dated 24.12.2025 registered under Section 21(b) of Narcotic
Drugs and Psychotropic Substances Act, 1985 (Section 29 of NDPS added later on) at Police Station Bhagta Bhai Ka, District Bathinda. Status report by way of an affidavit of Sh. Manoj Kumar, PPS, Deputy Superintendent of Police, Sub Division Phul, District Bathinda, on behalf of respondent No.1-State, has been filed in the Court today which is taken on record. Copy of the same has been supplied to learned counsel for the petitioner.
Learned counsel for the petitioner inter alia submits that the petitioner is innocent and has been falsely implicated in the present case. He was not named in the FIR and his name has surfaced in the disclosure statement of co-accused, namely, Randhir Singh @ Goldy from whose possession the recovery of 6 grams of heroin was effected, and the disclosure statement has no evidentiary value in the eyes of law. He has placed reliance upon the judgment of the Hon'ble Supreme Court in Tofan Singh Vs. State of Tamil Nadu : (2021) 4 SCC 1. He further submits that the petitioner is ready and willing to join the investigation.
Per contra, learned State counsel, in view of the averments made in the status report, vehemently opposes the grant of anticipatory bail to the petitioner. He submits that the petitioner is also involved in another case i.e. FIR No.23 dated 17.03.2025 registered under Section 22(b) of NDPS Act at Police Station Dialpura, District Bathinda, however, he is on bail in the said case.

In the meanwhile, arrest of the petitioner shall remain stayed. He shall join the investigation and co-operate with the investigating agency and shall not leave country without prior permission of this Court. 3.
Continuing his submissions, learned counsel for the petitioner contends that in compliance of the order dated 20.02.2026, passed by this Court, petitioner has joined the investigation, and has fully co-operated. Therefore, he prays for grant of anticipatory bail. 4.
In the facts and circumstances of this case this court does not find it necessary to keep the present petition pending any further and, accordingly, deems it appropriate to dispose of the same, with the direction to the petitioner to join the investigation within two weeks from today or as and when called by the investigating officer and in the eventuality of the arrest, petitioner would be released on anticipatory bail, subject to his furnishing bail bonds to the satisfaction of arresting officer. The petitioner shall also be abide by all the conditions laid down under Section 482(2) of BNSS, 2023 (earlier Section 438(2) Cr.P.C.).
Besides, it is directed that petitioner would hand over his passport to the Investigating Agency or to Court concerned, if he possesses. Otherwise, would submit an affidavit, disclosing the fact that he does not possess any passport.

It is also directed that before leaving country any time during trial, petitioner would seek prior permission of the Court. 7.
Accordingly, petition stands disposed of.
