Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner in case FIR No. 144 dated 16.04.2018, registered under Section(s) 22/21/61 of the Narcotic Drugs & Psychotropic Substances Act, 1985 at Police Station Dakha, Ludhiana.

Learned counsel for the petitioner contended that petitioner was earlier admitted to bail on 17.05.2018 and thereafter, he had been regularly appearing before the learned trial Court. However, bail of the petitioner was cancelled on 11.10.2018 on account of his non-appearance, which was due to miscommunication of the date by his counsel and now he is ready to surrender before the learned trial Court and furnish fresh bail bonds. Notice of motion.

In view of above, present petition stands disposed of with the directions that in case petitioner surrenders before the learned trial Judge within a period of one week from today and moves an application for grant of fresh bail to him, the learned trial Court shall admit him to bail on his furnishing fresh bail bonds with two sureties to its satisfaction. However, the learned trial Judge shall be at liberty to complete the proceedings under Section 446 Cr.P.C. against the petitioner.
