ARVIND SINGH SANGWAN, J. (Oral) The petitioner prays for grant of anticipatory bail in FIR No.37 dated 12.03.2016 registered under Sections 341, 323, 506, 298 IPC and 3(I)(r) & (s) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 at Police Station Sadar Fazilka. Counsel for the petitioner submits that the petitioner, in pursuance to the order dated 19.03.2018, has already appeared before the trial Court and he has been released on interim bail. It is further submitted that the co-accused of the petitioner namely Aad Ram and another have also been granted the concession of bail and they have also put in appearance before the trial Court in compliance with the order dated 16.02.2018 passed in CRM-M No.4764 of 2018, which was confirmed on 06.04.2018.

Counsel for the State, on instructions from HC Mukhtiar Singh, has not disputed the factual position and submits that the petitioner has already appeared before the trial Court. In view of the above, the petition is allowed and the interim bail granted to the petitioner vide order dated 19.03.2018 is made absolute subject to the conditions envisaged under Section 438(2) Cr.P.C.
