Petitioner has filed this petition under Section 482 Cr.P.C. against respondents State of Punjab and Manjit Singh for quashing of FIR No.228 dated 01.11.2015 under Sections 306 and 34 IPC registered at Police Station Samrala, District Ludhiana. Learned counsel for the petitioner argued that no offence is made out against the petitioner Karan Kumar and the FIR should be quashed.

After hearing learned counsel for the petitioner and after going through the record, I find that challan in the present case has not been presented so far as the investigation is going on. The perusal of the FIR, in no way shows that no offence is made out. As per the FIR, there are allegations that Jaswinder Singh's (deceased) wife is having illicit relations with present petitioner and despite the VINEET GULATI 2016.04.22 15:53 I attest to the accuracy and authenticity of this document Chandigarh

CRM No.M-11462 of 2016 -2best efforts, she has not given up the relations with the present petitioner and as per the FIR, Jaswinder Singh committed suicide by hanging himself from the ceiling fan.

As already discussed that the investigation is going on and the Investigating Officer is collecting the evidence, at this stage, this petition is premature. The role of the present petitioner and abetment, if any given by the present petitioner, is to be looked into from the evidence collected by the Investigating Officer. Therefore, at this stage, the present petition being premature, is dismissed.
