Petitioner seeks grant of anticipatory bail under Section 438 Cr.P.C in case bearing FIR No.0371 dated 10.09.2020 registered under Sections 323, 34, 506 IPC (Section 34 IPC has been deleted and Sections 148, 325, 308, 149 IPC have been added later on) at Police Station Ambala Cantt., District Ambala. Notice of motion was issued on 05.03.2021 and arrest of the petitioner was also stayed.

Today learned State counsel on instructions from DSP Ram Kumar, Ambala Cantt., Ambala submits that the petitioner has joined the investigation and his presence is no more JYOTI YADAV 2021.08.31 16:57 I attest to the accuracy and integrity of this document

CRM-M No.10421 of 2021(O&M) required for further investigation in the case. The petitioner was released on bail for the original offences under Sections 148, 323, 324, 506, 149 IPC. The offence under Section 308 IPC has been added later on. For enhanced culpability, the petitioner has joined the investigation to the satisfaction of the Investigating Officer and the petitioner is no more required for further investigation in the case. Even the challan has been filed before the Court.

Since the arrest of the petitioner was stayed and the challan has been submitted to the concerned Court, therefore, it would be just and appropriate to direct the trial Court to admit the petitioner on regular bail to its satisfaction. Petition stands disposed of.
