***** GURVINDER SINGH GILL, J. (Oral) Reply has been filed by learned State counsel, which is taken on record. A copy of the reply has been furnished to learned counsel for the petitioner.

Learned counsel for the petitioner submits that he may be permitted to withdraw the present petition at this stage with liberty to file afresh.

In view of the aforesaid request, the present petition is dismissed as withdrawn with liberty aforesaid.

Keeping in view the fact that the petitioner has been behind bars for a substantial period of about 2 years and 10 months and till date only 2 out of the cited 13 PWs have been examined and the remaining witnesses are all official witnesses and the matter is stated to be fixed for 2.8.2022 before PANKAJ KAKKAR 2022.07.28 17:36 I attest to the authenticity and integrity of this document

( 2 ) CRM-M-10337-2022 (O&M) the Trial Court for recording remaining prosecution evidence, the prosecution is directed to ensure the presence of PWs on the dates as may be fixed by the Trial Court for recording their statements. The Trial Court is directed to make a schedule in advance of the dates to be fixed and the witnesses to be summoned for such dates and to issue process immediately. If required, Senior Superintendent of Police concerned be also requested for ensuring the presence of remaining PWs. The Trial Court to record the statements of witnesses, whose presence is secured, at the earliest and not to causally entertain any request for adjournment made on behalf of the defence counsel.

Needless to mention, in case, there is inordinate delay in conclusion of trial, it shall always be open to the petitioner to approach this Court again.
