CORAM:

HON'BLE MR. JUSTICE INDERJIT SINGH

Present:

Mr.Ravinder Bangar, Advocate for the petitioner.

Mr.B.S.Virk, Deputy Advocate General, Haryana for the respondent-State.

Mr.Rakesh Nagpal, Advocate for the complainant.

**** INDERJIT SINGH, J.

Petitioner has filed this second petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.289 dated 08.08.2014 under Sections 302, 148, 149, 323, 341, 120-B and 506 IPC, registered at Police Station Pehowa, District Kurukshetra.

From the record, I find that during the pendency of the present case, the petitioner was released on interim bail as the application under Section 319 Cr.P.C. was pending before the trial Court. After hearing learned counsel for the parties as well as learned State counsel and after going through the record, I find that as per the Vineet Gulati 2017.08.04 16:48 I attest to the accuracy and authenticity of this document Chandigarh allegations, the present petitioner Anil Singh @ Anil Paunt stabbed

CRM No.M-1154 of 2016 -2complainant's brother Gaurav with knife on his chest and other accused kept on giving kick and fist blows. The petitioner is the main accused, who committed murder of Gaurav.

Keeping in view the facts and circumstances of the present case, nature and gravity of the offence, I do not find it a fit case where petitioner is entitled to benefit of regular bail. The application under Section 319 Cr.P.C., as stated, has already been decided by the trial Court. Therefore, finding no merit in the present petition, the same is dismissed. The petitioner is directed to surrender before the trial Court immediately. If the petitioner does not surrender immediately, then the trial Court is directed to issue non-bailable warrants against the petitioner and to take him in custody.
