Mr.Yashwinder Singh,DAG Haryana assisted by ASI Om Parkash Jaswant Singh,J(Oral) Prayer is for grant of regular bail to accused-Anmol Bhatt in case FIR No.590 dated 17.12.2015 under Sections 420,418,506,120-B IPC, PS Kotwali,Distt.Faridabad.

As per allegations petitioner accused-Anmol Bhatt and his coaccused non-applicant father Jagdish Bhatt are alleged to have purchased 900 tons of tin sheets from Ram Sarup-complainant and did not pay the entire amount due. Petitioner and his co-accused father are alleged to have sold the aforesaid material at reduced price to Dharmender Sharma and other shopkeepers.

It is contended that petitioner is in custody since 27.12.2015 and after completion of investigation challan stands presented. It is further submitted that evidence of 15 cited witnesses is yet to commence. Learned State counsel on instructions is unable to refute the custody period and stage of trial.

CRM-M 11557/2016 In view of the above,without commenting on the merits of the case and keeping in view the fact that neither trial is likely to be concluded in near future nor any useful purpose would be served by keeping the petitioner in custody,the present petition is allowed and petitioner is directed to be released on regular bail to the satisfaction of CJM/Duty Magistrate concerned.
