***** Rajan Gupta, J. (Oral) This is third petition under Section 438 Cr.P.C. for grant of prearrest bail to the petitioner in case registered against him vide FIR No.75 dated 24.07.2011 under Section 135 of the Electricity Act at Police Station Anti Power Theft, Ludhiana.
Petitioner could not appear before the trial court on three dates of hearing. This court directed the trial court to decide the matter afresh in case petitioner appears before it within 10 days. Thereafter, matter was considered by the trial court and again rejected the plea for bail. It is apparent that there was no fresh application of mind by the court below. Even otherwise, order is not happily worded.

Keeping in view the facts and circumstances of the present case, interim bail already granted to the petitioner on April 04, 2016, is made absolute. Accordingly, this petition is disposed of. At this stage, learned State counsel submits that in case petitioner does not appear before the trial court it may be given liberty to invoke relevant provisions of the law. Ordered accordingly.
