The petitioner apprehending arrest in the FIR captioned above, has come up before this Court under Section 438 CrPC seeking anticipatory bail. 2.

Vide order dated 21.02.2024, this Court had granted interim bail to the petitioner which is continuing till date.

Petitioner's counsel submits that the petitioner was Deputy Director and has since retired and he further contends that custodial interrogation and pre-trial incarceration would cause an irreversible injustice to the petitioner and family. 4.

The concerned DySP has filed reply dated 05.03.2024 and the same is taken on record. Relevant para 10 of the reply reads as follows:- "10. In compliance of above said order dated 21.02.2024 in present CRMM-, Rajender Singh Sangwan(petitioner-accused) has again joined the investigation of the present case on 27.02.2024 with the deponent and the petitioner-accused was formally arrested in the present case, his disclosure statement was recorded and thereafter in view of directions of Hon'ble High Court dated 21.02.2024, the petitioner-accused was ANJU RANI 2024.03.07 17:20 I attest to the accuracy and integrity of this document

CRM-M-9237-2024 2024:PHHC:032791 released on bail and his police custody is not required at this stage. However, the present petition is now fixed before this Hon'ble Court for 06.03.2024."
