This petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 seeking quashing of impugned order dated 02.12.2024 (Annexure P-2) passed by Chief Judicial Magistrate, Sirsa, whereby bail order of the petitioner has been cancelled, his bail/surety bonds were forfeited to the State and warrants of arrest were issued against him in case bearing FIR No. 143 dated 25.09.2018 registered under Sections 406, 420, 506, 34 of Indian Penal Code, 1860 (Section 201 of IPC added later on) registered at Police Station City Ding, District Sirsa, Haryana. 2.
Learned counsel for the petitioner submits that petitioner was on bail and was regularly appearing before the learned Trial Court. However, due to some communication gap between the petitioner and his counsel, he could not appear before the learned trial Court. Subsequently vide order dated 02.12.2024, learned trial Court cancelled the bail of the petitioner and warrants of arrest against him were issued.

On 13.02.2025, following order was passed:- "Contends that non-appearance of the petitioner on 02.12.2024, when the order impugned was passed, was not intentional; rather it happened on account of his ill health. Notice of motion.
Mr. Ashwani Kumar Saini, learned DAG, Haryana accepts notice on behalf of respondent-State; seeks time to have instructions and/or to file written response in the matter. Posted for 14.05.2025.
In the meanwhile, petitioner shall join the proceedings before learned trial Court and on doing so, he be released on interim bail in the present case till the next date of hearing on furnishing adequate bail and surety bonds subject to its satisfaction." 4.
Learned State counsel has filed status report/reply by way of affidavit of Raj Singh, HPS, Deputy Superintendent of Police, Sirsa on behalf of respondent-State in Court today, which is taken on record. Copy of the same be supplied to learned counsel for the petitioner. On instructions from ASI Anil, learned State counsel submits that in compliance of the aforementioned order, the petitioner has joined proceedings before learned Trial Court and has been released on bail.
