Notice of motion.

On the asking of court, Ms. Ishneet Kaur, AAG Punjab, who is present in court, accepts notice on behalf of the official respondent(s). Petitioner is aggrieved by decision of respondent no. 2 whereby plea of the petitioner for absorption as Home Guard Volunteer has been rejected on the ground that he did not report in time. Stand of the petitioner is, however, that he was working as a SPO and was not released by the parent department for almost four months. On 03.08.2012, Annexure P-2, he was released by the department whereafter he immediately reported before respondent no. 2. Due to this reasons, he could not report to Home Guard and Civil Defense Department within the prescribed time. A perusal of the impugned order, Annexure P-7 shows that this aspect has not been taken into consideration. To that extent, impugned order is non-speaking in nature. CWP No. 4625 of 2019 Annexure P-7 is hereby set-aside with liberty to the respondents to consider the entire issue afresh and pass an order within one month. Petition is allowed in these terms.
